On February 25, 2015, the U.S. Supreme Court issued its opinion in North Carolina State Bd. of Dental Examiners v. FTC, No. 13-534, slip op. (U.S. Feb. 25, 2015), holding that antitrust immunity is unavailable to state licensure boards where a “controlling number” of the board’s members are active, practicing members of the profession regulated by the board.
